A Federal High Court sitting in Maitama, on Wednesday, June 8, granted a cousin to former President Goodluck Jonathan, Robert Azibaola and his wife bail in the sum of N500m.
In his ruling, Justice Nnamdi Dimgba granted said the applicant must provide two sureties who are owners of properties in Abuja, Nigeria’s capital city.
He also said that the sureties must also show evidence of having paid tax for at least a minimum of three years.
“I have carefully read all the application submitted by the defendant and I have set N500 million for the two defendants – Mr and Mrs. Azibaola.
“Two sureties in like sum who must provide a bond.
“The sureties must own properties in Asokoro or Maitama and show evidence of tax payment for three years,” he said.
The judge also ruled that the registrar must verify all the above for final approval from the court.
Jonathan’s cousin and his wife, Stella will remain in Kuje prison till conditions are met.
Justice Dimgba said every citizen is assumed innocent until proven guilty convicted by a competent court of law.
He also said that all citizens undergoing criminal trial must be allowed access all necessary facilities even before conviction.
He however noted that unless there is a possibility that the accused person will evade trial, interfere with his trial while on bail or jump bail then he or she can be denied bail.
Justice Dimgba also said that the first defendant will remain in kuje prison custody pending when he meets the bail conditions.
Azibaola, his wife and their company are accused of receiving $40m from the office of the former National Security Adviser, NSA, Sambo Dasuki.
The case has been adjourned to June 28, July 4 and 5 for commencement of trial.
