The case, filed under suit number FHC/ABJ/CS/1819/2025, follows INEC’s decision on April 1 to remove the names of the duo, alongside other members of the party’s National Working Committee, from its official portal.
In a motion dated April 7, counsel to Mark, Sulaiman Usman, urged the court to grant a mandatory injunction directing the electoral body to restore the affected officials to their previous positions pending the resolution of the dispute.
The application, filed under relevant provisions of the Federal High Court rules and the court’s inherent powers, is seeking key reliefs, including nullifying INEC’s action of deleting the party’s leadership records and its refusal to monitor the party’s congresses or convention.
Part of the request asks the court to overturn INEC’s decision and order the immediate reinstatement of the ADC National Working Committee members as they existed before the controversy.
The party also wants the court to compel INEC to maintain the listing of Mark as National Chairman and Aregbesola as National Secretary, alongside other National Executive Committee members.
Additionally, the ADC is asking for an order restraining INEC from altering the leadership records or recognising any opposing claims until the case is fully determined.
